Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance agreement with the organization;
  • Day: calendar day;
  • Long-term transaction: a distance agreement related to a series of products and/or services, with obligations spread over time;
  • Durable data carrier: any means that enables the consumer or organization to store information in a way that allows future consultation and unchanged reproduction of the stored information;
  • Right of withdrawal: the option for the consumer to withdraw from the distance agreement within the cooling-off period;
  • Model form: the withdrawal form provided by the organization;
  • Organization: the natural or legal person who offers products and/or services to consumers at a distance;
  • Distance agreement: an agreement where one or more means of distance communication are used for its conclusion;
  • Means of distance communication: methods that can be used to conclude an agreement without the consumer and organization being in the same space at the same time.

Article 3 – Applicability
These general terms and conditions apply to every offer made by the organization and to every distance agreement between the organization and the consumer.
Before the agreement is concluded, the consumer will be provided with the text of these general terms and conditions.
If the agreement is concluded electronically, the text of these general terms and conditions will also be made available electronically.

Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
The offer is non-binding. The organization is entitled to modify or adapt the offer.
The offer contains a complete and accurate description of the products and/or services offered.
All images are a true representation of the products offered.

Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer.
If the consumer has accepted the offer electronically, the organization will confirm the receipt without delay.
The organization may, within legal limits, investigate whether the consumer can meet their payment obligations.

Article 6 – Right of Withdrawal

For the delivery of products:

  • The consumer may dissolve an agreement for the purchase of a product within a cooling-off period of 14 days without stating reasons.
  • During the cooling-off period, the consumer must handle the product and its packaging with care.

For the delivery of services:

  • The consumer has the right to dissolve the agreement for services without stating reasons within at least 14 days from the conclusion of the agreement.

Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, they are only responsible for the cost of return shipping.
If the consumer has already paid, the organization will refund the amount as soon as possible, but no later than 14 days.

Article 8 – Exclusion of the Right of Withdrawal
The organization may exclude the right of withdrawal for products as described in paragraphs 2 and 3.
Exclusion is only possible for products made according to the consumer’s specifications.

Article 9 – The Price
Prices of products or services listed in the offer include VAT.
Price increases within 3 months of the agreement’s conclusion are only allowed if due to legal provisions.

Article 10 – Conformity and Warranty
The organization guarantees that the products comply with the agreement and the reasonable standards of reliability.
Any warranty provided by the organization does not affect the legal rights of the consumer.

Article 11 – Delivery and Execution
The organization will exercise the utmost care when receiving and executing product orders.
The place of delivery is the address provided by the consumer.

Article 12 – Long-term Transactions: Duration, Termination, and Renewal

Termination:

  • The consumer can terminate an agreement entered into for an indefinite period at any time.
  • An agreement entered into for a definite period can be terminated at the end of its term.

Renewal:

  • An agreement for a definite period cannot be automatically extended or renewed.

Article 13 – Payment
Unless otherwise agreed, the amounts owed by the consumer must be paid within 7 business days after the cooling-off period. For services, this term begins when the consumer receives the agreement confirmation.
The consumer must promptly report any inaccuracies in the provided or stated payment details.
In the event of non-payment by the consumer, the organization may charge reasonable costs made known to the consumer in advance.

Article 14 – Complaints Procedure
The organization has a well-publicized complaints procedure and will handle complaints according to this procedure.
Complaints about the execution of the agreement must be submitted clearly described within 2 months of discovery.
Complaints will be answered within 14 days of receipt. If a complaint requires a longer processing time, the consumer will receive a response within 14 days indicating when a more detailed answer can be expected.
If the complaint cannot be resolved amicably, it becomes a dispute subject to dispute resolution.

Article 15 – Disputes
Agreements between the organization and the consumer are governed by Dutch law, even if the consumer resides abroad.
The Vienna Sales Convention does not apply.

Article 16 – Additional or Different Provisions
Any additional or differing provisions must not be to the consumer’s disadvantage and must be recorded in writing or stored in a way accessible to the consumer.
